In what scenario can an employee file a complaint to the Inspectorate (Inspectie SZW)?

You can file complaint to the Inspectorate SZW if your employer does not comply with certain rules. These rules relate to the terms of employment, working conditions, or working hours. You can also file a complaint about another company where such rules are being broken.

The Inspectorate of Social Affairs investigates violations pertaining to working conditions, working hours, minimum wage and minimum holiday allowance, and illegals and unregulated work.

First talk to your employer, and then file a complaint. You can try to resolve a complaint first with your employer or the company. If this is not possible, you can go to the Inspectorate SZW. You can submit your complaint via the digital notification form of the Inspectorate of Social Affairs website.

The Inspectorate SZW never announces to the employer that a complaint has been filed. If you would you still like to anonymously submit your complaint to the Social Affairs Inspectorate, the Inspectorate respects your right to privacy. In this case the Inspectorate cannot share the outcome of the investigation with you.
Sometimes the company or your employer will still have a suspicion that a complaint has been filed. The Inspectorate SZW will first consult with you about this. Only then will the Inspectorate continue with the handling of the complaint.

You do not need to report a serious accident as an employee yourself. A company has an obligation to report serious accidents, by telephone, directly to the Inspectorate SZW. This involves occupational fatalities, permanent injury or hospitalization.
