Salary requirements for Highly Skilled Migrants in 2022

The Immigration and Naturalisation Service (IND) published new salary thresholds for Highly-skilled Migrants, graduates, Intra-Corporate Transfers, and Blue Card holders in the Netherlands.
From 1 January 2022, the following salary limits will apply, based on gross monthly salary excluding 8% holiday allowance. Highly skilled migrants from 30 years of age or key personnel Intra-Corporate Transferee: € 4,840 (was €4.752) Highly-skilled Migrants younger than 30 years or key personnel Intra-Corporate Transferee: € 3,549 (was €3.484) Orientation year or lower salary threshold: € 2,543 (was €2.497) Blue Card holders: € 5,670 (was €5.670) As a reminder, all amounts are calculated on a gross monthly basis, excluding holiday allowance, and will need to be deposited directly into the bank account of the individual. Allowances/benefits can only be included if the following cumulative requirements are met: specified, fixed/guaranteed, paid structural on a monthly basis, in money (not in kind).

Terminating an employment contract through the court/UWV is time-consuming and expensive for employers. Therefore, many employers who need to reorganise their company will try to minimise dismissals by using an alternative process called termination by mutual consent. This is where the settlement agreement comes in.
Termination by mutual consent
In this process, employers ask selected employees if they are willing to terminate their employment voluntarily in exchange for a predefined package: a settlement agreement. This package can deviate from standard employment law, and may offer additional pay or benefits.
Interested employees are offered the settlement agreement and if they accept the offer, their employment will be terminated by mutual consent. Employees who decline will continue their employment without change.

Take action on time in the event of violation of a non-competition clause

If your (former) employee violates or threatens to violate the non-competition clause, you’ll want to take action as soon as possible to prevent the employee from running off with your knowledge and/or your customers. Two recent court rulings make it clear that you must do this quickly, because otherwise you will lose the right to invoke the non-competition clause at all.
If you wait too long, judges will rule that you as an employer apparently do not attach great importance to the non-competition clause and that the employee could therefore trust that the non-competition clause does not impede their work for the competitor or your relations.

So if you suspect or find out that the employee is going to work for a competitor or with your relations, quick action is required. The ‘s-Hertogenbosch Court of Appeal ruled on February 16, 2021 that an employer who waited three months was too late to invoke the non-competition clause. Dismissal (protection) of sick director

Media reports about Volksbank speak of a sickened atmosphere at the top of this "state bank. The CFO literally got sick of it on August 12, 2020. As of September 5, 2020, his resignation as a statutory director followed. Since then, the dismissal has been the subject of litigation. On June 15, the Court of Appeal ruled that the prohibition on giving notice due to illness applies and that the CFO is therefore entitled to continued payment of his salary of €23,000 gross per month. How does this actually work with the dismissal of a sick statutory director?
